1. Acceptance of Terms

By downloading, installing, or using Vidi ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Vidi is an iOS, iPadOS, and tvOS application that allows users to connect to SMB (Server Message Block) network shares to browse and stream media content. The App provides a client interface for accessing content stored on SMB-compatible servers and optionally syncs your connection settings across devices via iCloud.

3. User Responsibilities

You are responsible for:

• Maintaining the security and confidentiality of your SMB server credentials
• Ensuring you have proper authorization to access any SMB servers you connect to
• Complying with all applicable laws and regulations when using the App
• Ensuring you have the right to access and view any content you access through the App
• Your network security and the security of your SMB servers

4. Acceptable Use

You agree NOT to use the App to:

• Access servers or content without proper authorization
• Violate any local, state, national, or international law
• Infringe upon the intellectual property rights of others
• Distribute malware or engage in malicious activities
• Attempt to reverse engineer, decompile, or disassemble the App

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The App will be error-free or uninterrupted
• The App will meet your specific requirements
• Any content accessed through the App is accurate, complete, or reliable
• Your SMB servers will always be accessible through the App

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to your device or credentials
• Any content accessed through the App
• Any interruption or cessation of the App

7. Content and Intellectual Property

The App itself, including its code, design, and functionality, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal purposes.

Content accessed through the App remains the property of its respective owners. We make no claim to any content stored on SMB servers you access.

8. Privacy and iCloud Sync

Your use of the App is also governed by our Privacy Policy. The App does not collect or transmit your personal data to our servers. All credentials and settings are stored locally on your device using iOS Keychain. If you enable iCloud on your device, your connection settings will sync across your devices via Apple's iCloud Key-Value Store, which is encrypted and managed by Apple.

9. Updates and Modifications

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the modified Terms.

10. Termination

You may stop using the App at any time by uninstalling it from your device. We reserve the right to terminate or restrict your access to the App for violation of these Terms.

11. Third-Party Services

The App connects to SMB servers that you configure and optionally uses Apple's iCloud service for syncing connection settings. We are not responsible for the availability, content, security, or policies of any third-party servers, services, or cloud storage you access through or use with the App.

12. Indemnification

You agree to indemnify and hold harmless the App developers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App or violation of these Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

BY USING THE APP, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF SERVICE AND AGREE TO BE BOUND BY THEM.
